Terms of Service

1. Introduction & Acceptance

These Terms of Service (“Terms”) govern your access to and use of the PitchHighway application and website (collectively, the “Service”), operated by Gabriel Policiuc (“we,” “us,” or “PitchHighway”).

By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

The Service is available via web browser and as an iOS application. You must be at least 16 years of age to use the Service, in accordance with the General Data Protection Regulation (GDPR) age threshold for consent to data processing.

2. Definitions

• Service — The PitchHighway web application and iOS application, including all content, features, and functionality.
• User — Any individual who accesses or uses the Service.
• Content — All materials provided through the Service, including AI-generated songs, exercises, journeys, and instructional material.
• User Data — Information you provide or that is generated through your use of the Service, including account details and usage data.
• Voice Data — Pitch samples, MIDI note values, frequency measurements, confidence scores, and vocal range information derived from your voice input.
• Subscription — A paid plan granting access to premium features, purchased through Apple In-App Purchase.
• Guest Account — A temporary account that does not require registration and is subject to automatic deletion after 30 days of inactivity.

3. Account Registration & Security

The Service offers three types of accounts:

• Guest Account — No registration required. Guest accounts and all associated data are automatically deleted after 30 days of inactivity.
• Registered Account — Created with an email address and password. Provides persistent data storage and access across devices.
• Apple Sign-In Account — Created via Apple’s authentication service. Subject to Apple’s own terms of service.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Service Description

PitchHighway is a vocal pitch training application that provides:

• Pitch Detection — Real-time analysis of your singing pitch using on-device CREPE neural network processing.
• Learning Journeys — Structured, multi-level training programs with progressive exercises.
• Highway Mode — Gamified pitch-matching exercises set to music.
• Progress Tracking — Scores, streaks, personal bests, and completion history.
• Vocal Range Tracking — Detection and tracking of your singable pitch range over time.

5. AI-Generated Content

Songs and audio tracks available in the Service are AI-generated and commercially licensed. You are granted a limited, non-exclusive, non-transferable, in-app-only license to use this content solely within the Service for personal, non-commercial purposes. You may not download, redistribute, sublicense, or use the AI-generated content outside of the Service.

6. Subscriptions & Payments

Premium features are available through paid subscriptions, processed exclusively via Apple In-App Purchase.

• Plans — Monthly and yearly subscription options are available.
• Auto-Renewal — Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• Cancellation — You may cancel your subscription at any time through your Apple ID account settings in the App Store. Cancellation takes effect at the end of the current billing period.
• Refunds — All refund requests must be directed to Apple, as Apple processes all payments. We do not have access to your payment card information.
• Grace Period — If a renewal payment fails, Apple may provide a grace period during which your subscription remains active while payment is retried.

7. Voice & Audio Data

The Service processes your voice input to provide pitch training features. Specifically:

• Pitch detection is performed on your device using the CREPE neural network model. Raw audio is not transmitted to our servers for pitch analysis.
• Derived pitch data (MIDI note values, frequency, confidence scores) is sent to our servers for the purpose of tracking your progress, computing scores, and recording your vocal range.
• Audio recordings of your voice are stored only on your device and are never uploaded to our servers.

8. Intellectual Property

Our Content: All content, features, and functionality of the Service — including but not limited to design, code, AI-generated songs, exercises, and instructional material — are owned by PitchHighway or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of your voice recordings and any content you create using the Service. By using the Service, you grant us a limited, non-exclusive license to process your voice data and recordings solely for the purpose of providing the Service to you (e.g., pitch analysis, progress tracking, vocal range detection).

9. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service.
• Scrape, crawl, or use automated means to access the Service or extract data.
• Share account credentials with third parties or allow multiple individuals to use a single account.
• Circumvent, disable, or otherwise interfere with subscription-based access controls or premium features.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use the Service for any unlawful purpose or in violation of any applicable law.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

PitchHighway does not make any claims regarding medical, therapeutic, or health benefits. The Service is an educational and entertainment tool for vocal pitch training. Pitch detection accuracy may vary based on device hardware, environmental conditions, and other factors.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• PitchHighway’s total aggregate liability to you for all claims arising out of or relating to the Service shall not exceed the total amount you have paid to PitchHighway in the 12 months preceding the claim.
• In no event shall PitchHighway be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption.

EU Consumer Rights: Nothing in these Terms shall limit or exclude any liability that cannot be limited or excluded under applicable EU consumer protection law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

12. Indemnification

You agree to indemnify, defend, and hold harmless PitchHighway and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your misuse of the Service or violation of these Terms.

This indemnification obligation does not apply to the extent that the claim arises from our own negligence or wilful misconduct, and does not limit any rights you may have under mandatory EU consumer protection law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms.

You may terminate your account at any time by deleting your account through the Service. Account deletion will trigger cascading deletion of all associated data, including progress, vocal range data, and subscription records.

Sections 8 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law & Dispute Resolution) shall survive termination.

14. Changes to Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page will be revised accordingly. For material changes, we will notify registered users by email. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law principles.

If you are a consumer residing in the European Union, you retain the benefit of any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

The European Commission provides an online dispute resolution (ODR) platform, which you can access at https://ec.europa.eu/consumers/odr.

16. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and PitchHighway regarding your use of the Service.
